These general terms and conditions (GTC) regulate the rights and obligations of the contracting parties arising from the purchase contract concluded between the seller , which is Jana Kunecová , NIF: X5428277R, address El Viver , Carrer Sant Antoni 1, 17190 – Salt (Girona), Spain , with trade name GIRONAPROSPORT, ( hereinafter referred to as the ” Seller “) and the Buyer ,   consumers , whose object is the purchase and sale of goods on the web site of e- commerce vendor .

Buyers are in terms of these Terms and Conditions means the consumer .

Consumers are the purposes of these Terms and Conditions shall mean the natural person , who at the conclusion and fulfillment of the purchase contract does not act within the framework of the subject of its business activities , employment or occupation .

When placing an order, the buyer as a consumer shall state his name , surname , residential address , telephone number , e- mail contact .

The Contracting Parties are agreed , the buyer by checking the box before sending the order the seller confirms , that agrees with the team , that these general business terms and conditions and provisions will be applied to all purchasers of the contract , closed on any web page, e- commerce , which is operated by the seller . on the basis of which the seller delivers the goods presented on the present Web site buyer ( hereinafter referred to as ” purchase agreement “) and to all relationships between sellers and buyers , incurred mainly at the conclusion of the purchase contract and complaint of goods .

The General Terms and Conditions are an integral part of the purchase contract . In the case , the seller and the purchaser concluded a written purchase contract in which you agree conditions differ from general business conditions , will the provisions of the purchase contract be advertised prior to the general business conditions .

List of goods on any web page, e- commerce , which is operated by the seller , is a catalog of commonly delivered goods and the seller does not guarantee the immediate availability of all listed goods . The availability of the goods will be checked for the buyer after delivery of the confirmation of receipt of the order .

PRICES

All prices listed on the website www.gironporsport.com include VAT. The prices are given in euros (€). The price for transport will be added to the prices listed on the website . Information about the price for transport will be communicated to the buyer before the purchase of goods .

The prices of individual products are published in advance , before the order , for each product separately and are binding for the seller and buyer .

The seller can apply the right to unilaterally change the prices and content offer products , which are published on the web site www.gironaprosport.com. Adjusted prices do not apply to products already ordered by the buyer .

METHOD OF CONCLUDING A PURCHASE AGREEMENT

The purchase contract is concluded by the binding acceptance of the proposal for the conclusion of the purchase contract of the buyer by the seller in the form of an e- mail message from the buyer sent to the seller and / or in the form of the buyer’s completed and sent form on the seller ‘s website .

BUYER RIGHTS AND OBLIGATIONS

The seller is committed buyer to deliver the goods :

• Kind , quality , quantity mentioned in the order of the purchase price and payment conditions , which apply on the day of dispatch orders .
• Goods, which will be properly packaged to avoid to the damage during transportation .
• Valid tax document – invoice in electronic form by e – mail .

The seller is not responsible for:

• Delayed delivery of goods caused by post or courier service .
• Delays in delivery of goods culpable wrong given by the address of the recipient .
• For damage to the shipment caused by the post or courier service .
• Any non-delivery of goods , to which was due to the producer ( supplier ) or other unforeseen obstacles .

In case , if the ordered goods are not is available according to the data given on the website of Internet commerce , the seller is obliged to inform the buyer about this fact . The buyer is the basis of this fact, entitled to withdraw from the contract , or on the basis of an agreement with the seller modify the order .

Obligations of the buyer – Buyers are committed to :

• The buyer is obliged to persuade is that the product is in the required quantity , color , size before as place order .
• Truthfully and completely fill out the order form on the website seller .
• The ordered goods take , check the integrity of the packaging and in the event of any defects the seller shall immediately contact and inform him about the identified deficiencies .
• Pay the purchase price for the goods in the amount and in accordance with the payment terms valid on the day of sending the order and pay the price for delivery of the goods .

In case , if the buyer goods does not take ( on the basis of orders ), the seller can reserve the right to exercise their entitlement to compensation for the resulting damage .

The buyer accepts the tax document ( invoice ) in electronic form .

The seller is not responsible for incorrectly filled in the identification data of the buyer , which may result in non-delivery of the ordered product .

The seller can reserve in rare cases, the right to non-delivery of ordered product ( intervention force majeure , technical barriers to party seller , suspicion of misuse of the products on the criminal , or a similar activity , etc.). If the side of the buyer has been the payment of the ordered products , and from party vendor can lead to fulfillment , vendor returns back paid the purchase price to the buyer .

Seller bears to the buyer or to any third party any liability for any direct , or indirect damages ( including loss of profits ) caused by improper use of the purchased product .

TERMS OF PAYMENT

Gironaprosport accepts the following payment methods:

• Paypal
• Stripe (Visa / Mastercard)
• Payment by bank transfer

DELIVERY TIME (Slovakia, Czech Republic, Hungary, Poland) – delivery time is 4-5 working days from order confirmation with standard delivery , for express delivery it is 2-3 working days from order confirmation .

TRANSPORT PRICE (Slovakia, Czech Republic, Hungary, Poland)- for standard delivery 6 EUR, for orders over 100 EUR, standard delivery is free . For express delivery it is 19 EUR for packages up to 1 kg and 24 EUR for packages from 1 kg to 2.5 kg

COMPLAINTS / EXCHANGES / RETURNS

The buyer is entitled to apply to the vendor claims of defects , which had a product at the time of delivery , and also is entitled to claim the removal of defects .

If the buyer finds a defect in the product , he is entitled to file a written complaint about the purchased samples of documents exclusively at the email address of the seller , given in the contact details ( specifically : info@gironaprosport.com). Claim the buyer can apply within 3 days of delivery of the product .

Seller equip complaint within a period of 30 days from the application of the complaint .

The goods can be exchanged for another size or another model. The goods must be returned unused , in their original condition, with all tags and original packaging with a copy of the original invoice .

The buyer has the option to return the product without giving reasons within 14 days of its receipt . The buyer in this case will return the goods to the designated place ( collection point for the Slovak Republic ), he is required before sending the goods in writing notify the seller at the email address info@gironaprosport.com and goods must be returned unused , in original condition with all labels and original packaging with a copy of the original invoice .

The concluded business relations between the seller and the buyer are subject to the GTC valid and effective at the time of the given business relationship .

In the case , that some of the provisions of the GTC is invalid or ineffective , no such nullity or ineffectiveness to result in invalidity or ineffectiveness of other provisions of the GTC. In this case, the seller without undue delay replace the invalid or ineffective provision in a new way that has retained purpose , pursued by the relevant provisions at the time of its adoption .

The seller and buyer agree , that any service of documents between them in connection with the fulfillment of their rights and obligations will be carried out each e- mail .

The seller can reserve the right of changes and modifications in the GTC, these changes and modifications will be made available to the buyer on the site www.gironaprosport.com and will be applied only to purchases made after the change VOP.

These GTC come into force and effect on 1.2.2020.
